Annual Leave – Must Knows!

Employees are eligible to utilise their Annual Leave for vacations, relaxation, emergency or any such requirement. It is the right of the Employee to take Annual Leave subject to the right of the Employer to mutually agree on and schedule the time period for which the leave may be utilised. Annual Leave is generally calculated according to the employment type that could vary from full time or part time and from the time the job is taken on. Annual Leave holds much significance to the Employees hence there is a great degree of responsibility on an Employer to approve and enable Employees to utilise the said entitlement. Sound management of Annual Leave application is a good practice for all parties concerned. Mismanagement of it could negatively impact Employee performance, staff turnover and Employer- Employee relationship.

Annual Leave applications for Full & Part time Employees:

  • All Employees have the statutory right to get 5.6 weeks of paid Annual Leave. For those who work all five days of the week 28 days paid holidays are granted.
  • Those who work on part time basis are also entitled for the same level of holiday pro rata. Those working a four day week are entitled for 22.4 days of leave per annum.
  • Holidays are counted from the start date of employment
  • The Employer has the right to control when the Annual Leave is to be taken in fairness and mutual agreement with Employee
  • Employees are entitled for full pay while on Annual Leave
  • The Employer is able to determine inclusion of bank holidays or not, during said period
  • Employees are entitled to use their Annual Leave even with additional maternity, paternity and adoption leave
